Waiver Statement:

AGREEMENT, WAIVER AND RELEASE

I do hereby agree to indemnify and to hold harmless, release and forever discharge the Sedona Performing Arts Center, the International Hummingbird Society, the Northern Arizona Audubon Society, all Garden Tour property owners, private property owners, their officers, directors, agents, employees, volunteers, shareholders, respective affiliates and assigns (collectively, the “Released Parties”) from any and all liability, claims, demands, causes of actions, suits, damages, costs and expenses for any and all personal injuries, loss of time, pain and suffering and property damage which I may incur as the result of death or any injury or property damage that I may sustain while participating in any activity at this or any other Festival-sponsored facility and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Released Parties. It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns.

I understand that registration and attendance at the Festival and associated events constitutes an agreement by the registrant to the International Hummingbird Society’s use and distribution (both now and in the future) of the registrant or attendee’s image or voice in photographs, videotapes, electronic reproductions and audiotapes without compensation.

I agree to observe and obey all rules and warnings, and further agree to follow any oral instructions or directions given by the employees, representatives, affiliates or agents of the International Hummingbird Society.

I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE INTERNATIONAL HUMMINGBIRD SOCIETY.

By purchasing a ticket for the Festival and any related activities I agree to the terms and conditions of this agreement.
